Possibility for "MRTP" Action
25th Jan 1999 Latesh Chetnani @vsnl.com
Dear friends, I would like to know the option and your feedback on the subject of taking the mobile companies in Bombay namely BPL MOBILE & MAXTOUCH for their Atrocities and deliberate attitude against their existing subscribers. Can they be taken to "MRTP" on the basis of changing their billing and fees without informing and at their whims and fancies like: 1) charging for itemized billing which they gave free before 2) Switching from 1second billing to 10 second billing pulse 3) Charging of Rs. 5/- for their initial toll free 800 calls 4) And now they start charging for Caller Line Identification Presentation (CLIP) All these were given free earlier on just to rope the unsuspecting customer in to their service and now they start charging for the same, Giving the unfortunate subscriber no chance at all. Because if he does not agree then they ask him to cancel the service or switch over to another tariff plan which is more beneficial to the company. In other words which ever way you go the company has to gain. And if you want to switch your service provider then you are at the discomfort of informing all your clients & associates of the change in mobile number. Where we as users are at a lose as u cannot inform each & every person. What do you my friends feel of this should we let the 2 companies take us for granted and take us on a ride or should we give them what they deserve by hauling them over to MRTP I would like to hear your views on the above. I am for sure going forward with this issue. As i have not signed any documents which give them the right to charge me for CLIP which in the GSM Mobile phone is a standard and built in service. Looking forward for your response on the above. Hi : Latesh Chetnani suggested that due to a list of misrepresentations that these two cellular companies have made in Mumbai, they should be taken to consumer court or to MRTP. I whole heartedly support this. Latesh (and all other like minded people), please show me the way and I shall be willing to spend time, effort and money to take action against this fraud (Caller Line Identification is the last straw). I have been a subscriber to both MAX as well as BPL for a long time now. Please do let me know the procedure to take action. Thanks Ajeet Khurana

Hi Friends, Today I received my Bill from MAXTOUCH, which had along with it a circular stating that i am hereby informed of the CLIP Charges that would be effective from 1st Feb., 1999. I refused to accept the courier and sent it back to MAXTOUCH with a remark that the monthly bill envelope contained documents other then my Bill. After that I called the customer care center of Max to inform them of the same, while speaking to them they in form me that it is mentioned in the terms & conditions of the form that i have signed in Point no. 3 (h). I quote the same as written there; 3) REPRESENTATIONS & WARRANTIES OF HTML h) It has the sole right and discretion to vary the Charges levied by it and vary the tariff at any time with reasonable notice to Customers. When confronting the executive regarding what is the Reasonable Notice Period, she said that it' 30 days. Well to this date I have not received any written communications from them with regards to the same. I would appreciate the valuable comments & suggestions from the members of our list, hopefully we have some lawyers and other legal professional's in this list. And their comments would be highly appreciated. Look forward for your response With Best Regards, Latesh First Email: [email protected] EmailExpress, mailto: [email protected] Web Pager: http://wwp.mirabilis.com/8897710 Home page: http://www.angelfire.com/in/latesh/index.html ICQ Homepage: http://203.197.2.166/*55053
